Terms and conditions

TURISMO TERRES E.I.R.L. (hereinafter the Agency) wants you to enjoy your trip with us 100%. The following conditions are your contract with TURISMO TERRES E.I.R.L , so please read them carefully.

By booking a trip with us, you agree to these Terms and Conditions, which detail our policies, including those related to cancellations and liabilities. These conditions affect your rights and set out the applicable law. From the date of your first inquiry, the quote provided to you will be valid for 30 days. If you have any questions about your vacation, the booking process or the conditions of sale, please do not hesitate to contact the Agency; we will be happy to assist you. The quotations do not include your international flights from your place of origin to Peru and vice versa. Our prices do not include international flights to and from Peru, international airport taxes, meals not specified in the itinerary, personal expenses, personal insurance, tips and luggage transportation.

1.- CONTRACT BETWEEN THE CLIENT AND TURISMO TERRES E.I.R.L

To secure a reservation with THE AGENCY, the Client must deposit 30% of the total price of the trip to secure the spaces. The deposit is non-refundable. Customers who book by phone, whatsapp, instagram, facebook or email will be considered to have read the booking conditions. TURISMO TERRES E.I.R.L received the deposit from the Client. It is at this point that a binding contract arises between THE AGENCY and the customer.

The contract is made between THE AGENCY and THE CLIENT, which includes copy of passport or personal identification of all persons named in the booking form. The person signing (representative) the booking form warrants that he/she has full authority on behalf of all persons whose names appear on the booking form and confirms that all such persons are fully aware of and accept these conditions.

2.- PAYMENT

Deposit can be made by Western Union, or through our website with Visa or MasterCard, which will incur a 5.5% transfer fee paid by the traveler. Similarly, you can pay via wire transfer with a 5.5% transfer fee paid by the traveler (contact our sales department for information).

All deposits are non-refundable and non-transferable. Once the deposit is made and tickets and permits are purchased, the deposit is non-refundable and non-transferable to another date or person.

Permits are issued in the name and with the hiker’s passport number and cannot be transferred to any other person under any circumstances.

All prices are based on US dollars.

Our prices do not include Peruvian sales tax. Those exempt from paying this tax must comply with legal standards. For an IGV (general sales tax) exemption, the visitor (guest) must demonstrate that he/she meets the standards of international treaties recognized in Peru by showing a passport, driver’s license or national identity card. Please note that visitors who have stayed in Peru for more than 60 calendar days are no longer exempt from IGV (General Sales Tax). Also, make sure that your identity documents are legible and keep in mind that the TAM (Andean migration card) cannot replace a passport.

2.1.- FINAL PAYMENT

We recommend paying your final balance in cash in US dollars or soles at our office so that you do not have to pay the 5.5% transfer fee in the process. We accept any denomination, but not torn bills. If you wish to pay your final balance before arriving in Peru or Cusco, you can do so through Western Union, or through our website with Visa or MasterCard (which will incur a 5.5% transfer fee paid by the traveler) or through a bank transfer (with a 5.5% transfer fee paid by the traveler). For all tours, treks and packages if final payment is made online, payment must be made at least 6 days (144 hours) prior to the start date of your tour.

3.- CHANGES BY CUSTOMER

Any changes to the original reservation must be confirmed by the person signing the reservation form. For any changes by the Client to the itinerary after receiving a confirmed Travel Program from THE AGENCY, a fee of US$10 per fare change will apply, plus any costs or fees incurred or charged by our suppliers as a result of the modification. While every reasonable effort will be made to accommodate changes and additional requests, availability cannot be guaranteed.

4.- CUSTOMER SUBSTITUTION

If any member of your group is unable to travel, it may be possible to transfer the reservation to another suitable person, provided that written notice is sent at least 30 days prior to departure. An administrative fee of US $ 50 plus the costs imposed by THE AGENCY will be applied (may not be possible in reservations or packages that have Inca Trail services).

5.- CANCELLATION BY THE CUSTOMER

The Customer may cancel the reservation at any time provided that the cancellation is communicated in writing to THE AGENCY. The deposit paid to book the trip is non-refundable. Payments for flights over the Nazca lines and MACHUP PICCHU reservations are non-refundable due to the policy of the airline and the policies of the Ministry of Culture of the Peruvian state, which grants the allowed income according to the regulation. All other reservations cancelled less than 30 days prior to the tour departure date are subject to the following cancellation fees: Period prior to departure when written notice is received fee as a percentage of the refundable amount.

  • If you cancel between 4 and 2 weeks prior to departure, 60% of the total tour price is due.
  • If you cancel between 2 weeks and 5 days before departure, 80% of the total tour price is due.
  • If you cancel between 5 days and 36 hours before departure, 90% of the total tour price is due.
  • If you cancel 36 hours or less before departure: 100% of the total tour price is due.

6.- CHANGES AND CANCELLATION TURISMO TERRES E.I.R.L

TURISMO TERRES E.I.R.L will make every effort to operate all tours as advertised, by entering into this contract, the Client accepts that it may be necessary or advisable to vary or modify a tour itinerary or its contents due to prevailing local conditions. THE AGENCY reserves the right to cancel or change any of the facilities, services or prices (including flights, accommodation or other arrangements) at any time and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment as a result of these changes. If we become aware of a major change at the time of booking, the Client will be informed immediately. If a major change is required after booking, THE AGENCY will inform customers as soon as reasonably possible. When a major change is made, the Client will have the option to accept the change of arrangements, purchase any other available tour or cancel the tour and obtain a full refund. This is providing that the major change is not due to force majeure. Force majeure is war, threat of war, riot, civil strife, industrial disputes, terrorist activities, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transportation, changes imposed by cancellation or rescheduling of flights by an airline, disruption of airline, train, type of transportation or other similar events beyond the control of THE AGENCY.

THE AGENCY is not responsible for any charges in the event of a change – beyond its control – to the departure time or date of a tour, flight or other forms of transportation.

7.- SURCHARGES

In the event of a price increase, THE AGENCY will absorb the price increase if the price increase is equal to or less than 8% of the total package price. If the increase is more than 8%, the customer will be surcharged for the difference.

8.- PASSPORT, VISA AND VACCINATIONS

It is the client’s responsibility to possess a valid passport, visa permits, vaccinations and preventive medications that the authorities of the countries visited may require during the tour. Information on these matters or related items is provided in good faith but without liability on the part of THE AGENCY.

9.- AGE, FITNESS AND PARTICIPATION

All clients are expected to assess that their physical fitness aligns with the requirements of their chosen itinerary prior to booking. Travelers with pre-existing medical conditions are advised to consult with a health care professional prior to traveling on their chosen itinerary. Unaccompanied minors (under 18 years of age) are not accepted on tours operated by THE AGENCY, however, older teenagers may be considered provided they are accompanied by a parent or guardian who accepts full responsibility for the minor. THE AGENCY reserves the absolute right to refuse a booking at its discretion. Customers agree to accept the authority and decisions of THE AGENCY employees, tour leaders and agents, during the tour with THE AGENCY. If, in the opinion of such persons, the health or conduct of a Customer before or after departure appears to jeopardize the safe, comfortable or happy progress of an excursion, the Customer may be excluded from all or part of the tour. In the event of ill health THE AGENCY may make such arrangements as it deems appropriate and recover the costs thereof from the Client.

10.- LOCAL LAWS

All participants on tours operated by THE AGENCY are expected to obey the laws and regulations of the countries visited and failure to do so will relieve THE AGENCY of all obligations it may otherwise have under these booking conditions.

11.- ILLNESS OR DISABILITY

Any person suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment that may be required during the tour. Failure to make such disclosure will constitute a breach of these booking conditions and will result in such persons being excluded from the tour in which case all monies paid will be forfeited.

12.- CUSTOMER HAS A COMPLAINT

If the customer has a complaint about any of the tour arrangements, he/she should bring it to the attention of the tour leader or other representatives of THE AGENCY at the appropriate time so that they can make their best efforts to rectify the situation. Only if THE AGENCY becomes aware of a problem will there be an opportunity to correct it. Making your complaint known to THE AGENCY, as a problem arises during your trip, will allow us to remedy the situation or facilitate a solution/compensation (as appropriate). If the problem is not resolved, a written complaint must be submitted to THE AGENCY within 15 days of the end of the vacation.

13.- FLIGHT BOOKINGS

THE AGENCY will make every effort to ensure that all flight prices are correct at the time they are quoted. The airlines reserve the right to change or withdraw fares without notice. Once a deposit is paid on an airline ticket, it guarantees that a reservation is made for you, but it DOES NOT GUARANTEE the fare. The fare can only be guaranteed when the flight reservation has been paid in full and a ticket has been issued. Flight reservations cannot be transferred.

Flight schedules offered by THE AGENCY are for general guidance only and are subject to change. Updated flight times will be shown on the tickets. The Customer should check the tickets very carefully immediately upon receipt of the latest times. THE AGENCY will endeavor to inform the Customer as soon as possible in case of any alteration in the flight. Airline details are also subject to change. Such alterations do not constitute a significant change in travel arrangements and therefore you will not be entitled to cancel without paying the normal charges as a result.

THE AGENCY is not responsible for any delay in your flight whether due to adverse weather conditions, the action of air traffic controllers, airport authorities or (local) governments, rescheduling of flight schedules by the airline, mechanical breakdowns, strike, industrial action or any other reason.
